These Terms & Conditions govern your use of services provided by KoncordINC. By engaging with our billing, coding, or RCM solutions, you agree to comply with all outlined policies regarding service delivery, data confidentiality, payment terms, and legal jurisdiction. Please review carefully to ensure mutual understanding and compliance.

Terms & Conditions

Effective Date: 03/10/2023

These Terms & Conditions (“Agreement”) govern the provision of services by KoncordINC to its clients. By engaging KoncordINC‘s services, the client agrees to be bound by the terms outlined herein.


1. Scope of Services

KoncordINC offers a comprehensive suite of healthcare support services, including but not limited to:

  • Revenue Cycle Management (RCM)
  • Medical Billing & Coding
  • Accounts Receivable (A/R) Management
  • Claims Submission & Denial Management
  • Care Gap Analysis
  • Insurance Verification & Eligibility Checks
  • Specialty Billing (e.g., Durable Medical Equipment, Pharmacy, Orthopedic, Home Health, Wound Care)
  • Data Reporting & Revenue Cycle Analytics

All services provided will be detailed in the individual Service Agreement signed by the client and KoncordINC.


2. Client Responsibilities

Clients are expected to:

  • Provide accurate, complete, and timely clinical and billing information necessary for KoncordINC to perform its services effectively.
  • Maintain all necessary provider enrollments and credentialing.
  • Respond promptly to information requests from KoncordINC.
  • Ensure that all clinical decisions are made by licensed medical professionals within their practice.

KoncordINC shall not be held responsible for delays or errors resulting from incomplete or inaccurate information provided by the client.


3. Data Privacy & HIPAA Compliance

KoncordINC is committed to maintaining the confidentiality and security of all patient information in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable federal and state laws. Measures include:

  • Encryption of all data transmissions and storage.
  • Execution of a Business Associate Agreement (BAA) with each client, detailing privacy responsibilities.
  • Regular training of staff on data privacy and security protocols.

4. Fees and Payment Terms

  • Service fees will be outlined in the individual Service Agreement and may be structured as flat-rate, per-claim, or percentage-based models.
  • Invoices are issued monthly or as specified in the Service Agreement.
  • Payments are due within 30 days of the invoice date. Late payments may incur a service charge of 1.5% per month on the outstanding balance.
  • Clients must notify KoncordINC of any billing disputes within 10 days of receiving an invoice.

5. Service-Level Agreements (SLAs)

KoncordINC is committed to delivering services in a timely and efficient manner. Standard SLAs include:

  • Claim Submission Turnaround: Within 48 hours of receiving complete documentation.
  • Insurance Verification: Within 24 business hours of request.
  • A/R Follow-Up Cycle: Every 14–21 days.
  • Denial Reprocessing: Within 3 business days of denial identification.

Specific SLAs may vary based on the client’s practice size, specialty, and Electronic Health Record (EHR) integration and will be detailed in the Service Agreement.


6. Performance Reporting

KoncordINC will provide clients with regular performance reports, which may include:

  • Days in Accounts Receivable (A/R)
  • Claim acceptance and rejection rates
  • Net collection rates
  • Denial trends
  • Care gap compliance rates (for applicable services)

Reporting frequency and content will be specified in the Service Agreement.


7. Confidentiality

Both KoncordINC and the client agree to maintain the confidentiality of all business, financial, operational, and patient information. This obligation extends beyond the termination of services. KoncordINC will not disclose client data to third parties without written consent, except as required by law.


8. Limitation of Liability

KoncordINC shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use its services, except in cases of gross negligence or willful misconduct. The client’s exclusive remedy for any breach of this Agreement by KoncordINC shall be limited to the amount paid for the services in question.


9. Indemnification

The client agrees to indemnify and hold harmless KoncordINC, its affiliates, and employees from any claims, damages, or expenses arising from:

  • The client’s breach of this Agreement.
  • Errors or omissions in the information provided by the client.
  • Clinical decisions made by the client’s personnel.

10. Termination

  • Either party may terminate this Agreement with 30 days’ written notice.
  • Upon termination, KoncordINC will complete any in-progress services up to the termination date.
  • The client is responsible for settling all outstanding invoices prior to the effective termination date.
  • KoncordINC will provide a final data export or handover upon request.

11. Refund & Credit Policy

Due to the nature of the services provided, refunds are generally not applicable. In the event of service deficiencies or errors attributable to KoncordINC, the company may offer service credits or reprocessing at no additional cost, subject to investigation and mutual agreement.


12. Modification of Terms

KoncordINC reserves the right to update or modify these Terms & Conditions with 15 days’ written notice. Continued use of KoncordINC‘s services after such modifications constitutes acceptance of the updated terms.


13. Force Majeure

KoncordINC shall not be held liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, cyberattacks, labor strikes, or governmental actions.


14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Koncord Inc. (d/b/a KoncrodINC) is legally registered. Any disputes, controversies, or claims arising out of or relating to this Agreement shall be exclusively resolved in the competent courts located within said jurisdiction.


15. Dispute Resolution

  • The parties agree to attempt to resolve any disputes arising under this Agreement through good faith negotiations.
  • If unresolved, disputes may be submitted to mediation or arbitration, as mutually agreed upon in writing.

16. Entire Agreement

This Agreement, along with any Service Agreements and Business Associate Agreements, constitutes the entire understanding between KoncordINC and the client regarding the subject matter herein and supersedes all prior agreements and understandings.
